Community members of Kendall and surrounding locations are being urged to have their say on the latest plan for development of a Manufactured Home Estate at Batar Creek Road.

A public meeting was on Thursday, July 19 and enabled residents to voice any issues or concerns they had with the development.
A representative of the Kendall resident’s committee David Adamson said the development at 79 Batar Creek Road, Kendall is in conflict with the zoning regulations which apply to the proposed site.
Mr Adamson said the proposed site has R1-general residential zoning under the council’s Local Environment Plan (LEP).
“The development proposes the construction of a gym, games area, tennis court, swimming pool, golf driving range and bowling green all of which are prohibited within R1 residential zoning,” he said.
A spokesperson for Camden Haven Lifestyle Village Pty Ltd said it was unfortunate they were not invited to attend the meeting to have the opportunity to clarify the zoning issues raised.
“The community facilities form part of the development application for the Manufactured Housing Estate and are not being applied for as a recreational facility under the LEP," the spokesperson said.
“Consent is being sought for the Manufactured Housing Estate including the sites, internal private roads and community facilities under SEPP 36 – Manufactured Home Estates.
“The land is zoned R1 – Residential under Port Macquarie-Hastings LEP 2011.
“Caravan parks (which are required to be permissible in the zone to allow for a Manufactured Housing Estate) is a permissible land use within the zone.
“The community facilities included in the proposal for Woodglen Lifestyle Estate are considered suitable under Local Government (Manufactured Home Estates, Caravan Parks, Camping Grounds and Moveable Dwellings) Regulation 2005."
Mr Adamson said about 75 Kendall residents attended the meeting and a show of hands unanimously voted to object the proposed development.
He said this was due to considerable concern about the impact the estimated increase in traffic would have on neighbourhood roads.
A council spokesperson confirmed approval is being sought for the Manufactured Housing Estate (MHE) in accordance with SEPP 36 – Manufactured Home Estates.
“The subject land is zoned R1 – Residential under the Port Macquarie Hastings LEP 2011,” he said.
“Subdivision and caravan parks are permissible land uses within the R1 zone by virtue of them not being expressly prohibited in the R1 zone.
“This is what is called an “open zone” which essentially means the uses that are prohibited are listed and anything else is permitted with development consent.
The spokesperson said proposed recreation facilities would be considered as being ancillary to the development and thus also permitted with consent.
Community submissions in response to the development application are due by August 13.
